In NSW, the opportunity to classify surplus soil excavated from a site as ‘Virgin Excavated Natural Material’ (VENM) or ‘Excavated Natural Material’ (ENM) helps ensure soils generated during development, civil works and bulk earthworks are managed lawfully and sustainably. The NSW EPA Resource Recovery framework sets clear criteria to distinguish natural, uncontaminated material from waste, supporting compliance, reducing landfill volumes and promoting circular economy outcomes across construction and infrastructure projects.
Correct classification has significant financial and environmental benefits. Where material can be certified as VENM or ENM, it can be reused where applicable as structural fill or in landscaping earthworks at suitable receiving sites, avoiding unnecessary disposal as industrial waste, reducing landfill volumes and saving disposal costs—while keeping a valuable resource in use.
Given the complex land-use history across NSW, and the potential for contamination to impact natural soil, it is imperative that any soil requiring excavation and movement offsite is first given an appropriate classification. A ‘VENM’ classification can only be given to naturally occurring soil, sediment or rock that is undisturbed (in-situ), uncontaminated and contains 100% natural material. An ‘ENM’ classification applies to excavated material that comprises at least 98% natural material – as demonstrated through comprehensive field inspection and laboratory testing. Failure to correctly classify material before moving it from one site to another can result in penalties associated with illegal dumping.
